Legal & compliance

The legal foundations of eSignatures, in one place

Under EU Regulation 910/2014 (eIDAS) and the UK eIDAS Regulations 2016, an electronic signature has the same legal effect as a handwritten one and cannot be denied admissibility just because it is electronic.

In the United States, the Electronic Signatures in Global and National Commerce Act (ESIGN Act, 2000) and the Uniform Electronic Transactions Act (UETA) (adopted by 49 states) give electronic signatures equivalent legal status to wet-ink for nearly all commercial transactions.

SES is not suitable for a small set of documents that require additional formalities — wills, certain real-estate transfers, and notarial deeds. For those, consult a solicitor or use a Qualified Electronic Signature (QES) provider.

  • UK & EU eIDAS aligned (SES)
  • ESIGN Act + UETA compliant (US)
  • GDPR & UK GDPR compliant
  • TLS 1.3 in transit, AES-256 at rest
  • EU-hosted data, never used for AI training
  • SHA-256 document hash on every signature

FAQ

Common questions

What is an electronic signature (eSignature)?+

An electronic signature is any electronic indication of intent to agree to the contents of a document. Under UK & EU eIDAS, the US ESIGN Act, and UETA, eSignatures have the same legal weight as wet-ink signatures for the vast majority of contracts.

Are SigningVault eSignatures legally binding?+

Yes. SigningVault eSignatures qualify as Simple Electronic Signatures (SES) under UK & EU eIDAS, the US ESIGN Act, and UETA. Each signature includes timestamp, IP, device, explicit consent and a SHA-256 document hash, all recorded in a tamper-evident audit trail.

What's the difference between SES, AES and QES?+

Under eIDAS: SES (Simple) is the standard accepted for nearly all commercial contracts. AES (Advanced) requires unique signer identification. QES (Qualified) requires a qualified certificate from a trust service provider — needed for a few specific document types like notarial deeds.

Can I eSign a PDF I already have?+

Yes. Upload any PDF or DOCX, place signature, date and text fields where needed, and send the recipients a private signing link. They sign in-browser — no account required.

What countries does SigningVault work in?+

Anywhere. SigningVault is built on internationally recognised standards (eIDAS, ESIGN, UETA) accepted by HMRC, Companies House, the IRS, and equivalent authorities across the EU, UK, US, Canada, Australia, and most of the world.

What's in the audit trail?+

Signer name, email, IP address, device fingerprint, geolocation, timestamp, explicit consent acceptance, and a SHA-256 hash of the signed document. Attached to every completed contract as a Certificate of Completion PDF.

Is data hosted in the EU?+

Yes. SigningVault's data is encrypted in transit (TLS 1.3) and at rest (AES-256), hosted in the EU. We're GDPR and UK GDPR compliant and never train AI models on your contract content.
